Brief Case History
Hugh David Pernell, a 61 year-old mail carrier, was shot and killed early on May 15, 2000. The shooting occurred in front of the home of Charles Rice. Rice saw two cars, and he saw Pernell shot once. Officers received a tip that Curtis Lipsey was involved, and it was then discovered that he, Adam Ray, and Marlon Howell were all riding around together. Both Lipsey and Ray turned on Howell, who attempted to provide an alibi but failed at doing so convincingly. During the trial, Marcus Powell testified that Howell told him the night prior to the killing that he needed money to give to his probation officer. Howell was convicted of capital murder and sentenced to death in March 2001. Since his conviction, he has appealed several times. His first appeal involved questioning the credibility of Charles Rice due to his criminal background and the fact that the state had withheld information about Rice’s past.
