Brief Case History
Bobby Wilcher was convicted of two separate counts of capital murder in 1982. He was sentenced to death for these crimes. Wilcher made direct appeals to both counts, which were denied in 1984. He then sought post-conviction relief for both counts, which were again denied, before petitioning a writ of habeas corpus. This, too, was denied.
Wilcher’s death sentence was found improper by a Federal Circuit Court and both cases were sent back to the Scott County Circut Court for resentencing. A jury sentenced him to death for one of the original murder convictions. Wiclher and his legal team filed motions for post-conviction relief, which were denied, and his execution was set for July 2006. The United States Supreme Court halted Wilcher’s July execution while they were reconsidering his case. Wilcher was then executed on October 18th, 2006.
