Clyde Wendal Smith was convicted of capital murder, aggravated assault, and carrying a concealed weapon on July 1, 1993. Smith, and his brother Jerome Pete Smith, were convicted for the November 7, 1992 murder of Johnny B. Smith. Johnny Smith was killed by three gunshot wounds at the liquor store he owned in Sidon, Mississippi. At the crime scene, Johnny B. Smith’s .32 or .38 caliber weapon was also gone, and the projectiles recovered from his body were consistent with those of a .38 caliber weapon. Fingerprints and a palm print recovered from a brown paper bag on the liquor store countertop were identified as Clyde and Jerome’s. Eyewitness testimony also played a factor in the brothers’ conviction when Johnny B. Smith’s son, Kevin Smith, identified them at the trial, as did a cap worn by one of the brothers on the night of the murder.
