Brief Case History

Earl Berry was convicted of capital murder and sentenced to death. Berry and his legal team appealed and, though the conviction stayed, his case was remanded for resentencing in 1990. Berry was again sentenced to death.

Berry and his legal team made a number of appeals and petitions for relief. They raised issues on the jury selection during his resentencing trial and noted that Berry was considered mentally retarded and had a history of hospitalization. All petitions and appeals were denied.

Berry was set to be executed in 2007 when his execution was halted by the United States Supreme Court. Berry was subsequently executed on May 21st, 2008.
