Brief Case History
Gary Simmons was sentenced to death on August 29th, 1997 as the result of his trial for capital murder, kidnapping, and rape. Simmons’ trial lasted only four days.
After sentencing, Simmons and his legal team filed two petitions for post-conviction relief. Both of these petitions were denied. They eventually filed a Habeas Corpus - Death Penalty appeal directly against Christopher Epps, the MDOC Commissioner. That, too, was denied.
