Brief Case History

Tony Clark was found guilty of capital murder, attempted murder, and possession of a firearm by a previously convicted felon. Clark and another man robbed a gas station in Canton, Miss. and killed the store’s owner.

During jury selection, the prosecution used seven of their twelve peremptory strikes against African American jurors and five against Caucasian jurors. The final jury consisted of eleven white jurors, one black juror, with the two alternates also being white. Clark claimed that the state treated black and white venire members differently. Clark alluded to the state targeting African Americans through racially disparate questioning.
